A prerequisite for opening your online shop is to register a trade. Before you can take this step, however, you must consider which legal form is suitable for you as an online trader.
As an operator of an online shop, for example, the following legal forms are possible:
Sole proprietorship
Registered trader
GbR (partnership under civil law)
OHG (general partnership)
KG (limited partnership)
GmbH (limited liability company)
UG (limited liability) (entrepreneurial company)
GmbH & Co. KG (limited liability company & limited partnership)
AG (public limited company)
The most popular legal forms for an easy start in your e-commerce business are sole proprietorship and GbR, which differ in particular in the number of persons. As a sole proprietor, you start with no minimum capital, low start-up costs and benefit from simple bookkeeping, for example. However, you naturally also bear full responsibility and are liable with your private assets. This also applies to a GbR. This is different, for example, with a limited liability company (GmbH) as a corporation, where you can protect your private assets by limiting your liability.

To set up a sole proprietorship or GbR, go to your local trade office, where you can register your business after a little paperwork. They will forward the data to the tax office, which will issue you with a tax number.
In the course of setting up your business, you should also check the availability of the shop or brand name you want and register the brand if necessary. It would not be a good idea to start your shop directly with a trademark infringement.
